What You Need to Know Before Hiring a Local Disability Attorney

Jun 21, 2023

If you have been struggling with getting your disability approved, you may need to hire a local disability attorney to do so. A local disability attorney will fight for your right to disability. However, there are a few things you need to know before you hire a local disability attorney.

Understand Contingency Collections

Disability attorneys often work on contingencies. Contingency means you don't have to pay upfront out-of-pocket for the services. However, the service is not free. You do have to pay, but you don't pay until your claim is settled. This can be an excellent benefit for someone that can't pay upfront fees.

How much the attorney can collect is regulated by the Social Security Administration. According to Disability Benefits Help, a disability attorney cannot collect more than 25% of your back benefit pay, and the amount is capped at $7,200 but may increase from time to time according to the Social Security regulations. You do pay for the services, but you don't pay out-of-pocket.

Gather Your Documents

The attorney will fight for you in your unique disability case, but you have to be an active participant in the process. The attorney will need evidence of your disability in the form of medical records. The easiest way to get medical records is for you to ask for them from your treating physicians.

Having the documents that your attorney needs will help to move your case along. If you have difficulty getting the records, your attorney can help. However, do all you can to ensure that you have your records and medical files ready beforehand.

Do Your Due Diligence

Before you decide which attorney is right for you, be sure to do your due diligence. Read reviews about other clients' experiences with the attorney. Check with the BAR association in your state to ensure that no serious complaints have been filed against the attorney by a client.

Checking the reputation of the attorney by reading reviews will give you a better idea of what you can expect as a client. Another key thing to look for is responsiveness. If you leave a message and the attorney or a representative from the office takes longer than 24 business hours to reply, it can be a red flag.

You should always choose a local disability attorney that has experience helping others in your community. National disability legal teams do not have the specialized experience that a local attorney does. Call Russell W Pope Sr. LLC today to speak with a local attorney who is passionate about helping clients get the disability they deserve.
